Terms and Conditions of Purchase

  1. Any contract for purchases made through this website will be with Troubador Publishing Limited, whose registered office is situated at Unit E2 Airfield Business Park, Harrison Road, Market Harborough, Leics LE16 7UL, company registration number 3233109 (Troubador).
  2. Troubador must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been received Troubador will confirm that your order has been received by sending an email to you at the email address you provided in our online order form. Our acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
  3. Troubador are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Withdrawal By You From the Contract

If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract. These are set out here:

  1. You may withdraw your order for goods at any time up to the end of the 14th day after you have received the goods. You do not need to give Troubador any reason for withdrawing your order, nor will you have to pay any penalty.
  2. The only circumstance in which you cannot withdraw your order is where you have taken the goods you have ordered out of the sealed package in which they were delivered.
  3. To withdraw your order you must notify Troubador in writing at orders@troubador.co.uk no later than 14 days after delivery of the goods.
  4. If you have received the goods before you withdraw your order then you must send them back to the Troubador return address at your own cost and risk. If you withdraw your order but Troubador has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to us at the return address at your own cost and risk as soon as possible.
  5. Once you have notified Troubador that you are withdrawing your order, any sum debited to Troubador from your credit or debit card or PayPal account will be re-credited to your account, as soon as possible after we have received the returned goods, but no later than 14 days. No credit can be made until we receive the returned goods and have confirmed that they are undamaged.

Availability of Goods You Order

In some circumstances, we may advertise a book as being available when we no longer hold stock. In this case we shall notify you of this and refund any payment made by you for the order. Troubador will not be obliged to offer any additional compensation for the disappointment suffered.

Delivery of Goods to You

  1. Troubador will post, or arrange to courier, the goods ordered by you to the person and address you give in your order at the time you make your order. For goods delivered outside of the UK, the consignee (ie the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes, where required.
  2. Delivery will be made as soon as possible after your order is accepted; in the UK this will be within 30 days of dispatch of the order; outside the UK, this will be within 90 days of the date of despatch. No claim for non-delivery of goods can be accepted until these time periods have elapsed.
  3. Troubador will endeavour to make delivery to you as soon as possible after an order has been placed, but can make no guarantee that delivery will be made to a particular time schedule you request. Troubador shall bear no responsibility should an order not arrive in time for a certain date (eg. Christmas, a scheduled event), nor be liable for any loss of income or costs incurred as a result of goods not arriving by the date requested.
  4. Goods are deemed to have been delivered when they arrive at the address given at the time you placed the order, and at that point Troubador’s liability for the goods ceases. Should you request that the goods are left with a neighbour, delivered to a third party or left in a safe place, responsibility for the goods passes to you at the point of that delivery.

Customs Charges

If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to VAT (Value Added Tax), other taxes, customs duties and/or fees levied by the destination country or local delivery services. Any such charges levied in relation to customs clearance or local delivery charges must be borne by you; Troubador will not reimburse the customer for customs charges, or charges levied by local delivery services such as fuel surcharges, power surcharges, etc. Nor will Troubador accept the cancellation of an order because the customer refuses to accept the delivery because of local taxes or surcharges levied outside our control at a local level. It is accepted by you that Troubador has no control over additional charges in relation to customs clearance or supplementary local delivery charges. We recommend that you check with your local customs officials, post office or courier service for more information regarding importation taxes/duties or transport surcharges that may be applicable to your online order.

Liability

This is as follows:

  1. If the goods Troubador delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Troubador shall have no liability to you unless you notify Troubador of the problem, in writing to orders@troubador.co.uk, within 14 working days of the delivery of the goods in question.
  2. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you (90 days for overseas orders), Troubador shall have no liability to you unless you notify us in writing of the problem within 44 days of the date on which the goods were dispatched to you (104 days for overseas orders).
  3. If you notify a problem to Troubador under this condition, our only obligation will be to make good any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.
  4. Troubador will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
  5. Should delivery not be made because you have given an incorrect or incomplete delivery address at the time at which you placed the order, then Troubador will not be liable for non-delivery of the goods and is not obliged to make a refund to you.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

Force Majeure

Troubador shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These Terms and Conditions, together with the current Troubador website prices, delivery details and Troubador contact details, set out the whole of our agreement relating to the supply of the goods to you by us. These Terms and Conditions cannot be varied except in writing signed by a director of Troubador. In particular, nothing said by any sales person on behalf of Troubador should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods offered for sale by Troubador. Troubador shall have no liability for any such representation being untrue or misleading.
